In this decision, the Colorado Supreme Court discharges a rule to show cause it issued under C.A.R. 21, holding that Colorado’s recently-enacted statutory scheme for resentencing juvenile offenders with unconstitutional sentences according to the U.S. Supreme Court’s decisions in Miller, 567 U.S. 460 (2012), and Montgomery, 136 S.Ct. 718 (2016), does not violate the Special Legislation Clause of the Colorado Constitution. The Court rejects the People’s arguments, holding that Colorado Revised Statute 1-1.3-401(4)(c) creates a genuine class and that its legislative classifications are reasonable.
