On November 7, 2022, the Colorado Supreme Court issued a decision in RW v. People in Interest of EW 22 CO 51 (Nov. 7, 2022). In this case, the Supreme Court held that Colorado does not lose jurisdiction of a case under the UCCJEA simply because a child is placed out-of-state, and the parents then move to that same state. Essentially, this case confirms that when Colorado has obtained initial jurisdiction to oversee a child-custody proceeding under the UCCJEA, it does not automatically lose jurisdiction when the parents and child leave the state.
